Introduction

Welcome to Kharmiley Tours and Travels! These Terms and Conditions ("Terms") govern your use of our travel services and bookings. By making a booking with us, you agree to be bound by these Terms. Kharmiley Tours and Travels is a Govt. registered tour operator based in Namchi, Sikkim, specializing in tours across Sikkim, Darjeeling, BAUDHA, South and North-East India, Nepal, and Bhutan.

Acceptance of Terms

By using our services, you confirm that:

• You are at least 18 years old and have the legal capacity to enter into a binding contract
• You accept and agree to be bound by these Terms
• All information you provide is accurate and complete
• You understand that Kharmiley Tours and Travels acts as an intermediary between you and various service providers

Booking and Payments

Reservations

All tour bookings made through Kharmiley Tours and Travels are subject to availability and the terms and conditions of our service providers (hotels, transport operators, etc.). We specialize in tours across Sikkim, Darjeeling, BAUDHA, South and North-East India, Nepal, and Bhutan.

Pricing

Tour prices are subject to change without notice until full payment is received. Prices may increase due to factors beyond our control, including government taxes, fuel surcharges, and currency fluctuations.

Payment

We require a 30% advance payment to confirm bookings. Full payment must be made 15 days before the tour start date. We accept bank transfers, UPI, and major credit cards (additional processing fees may apply).

Cancellations and Changes

Cancellation by You

Cancellation policies vary by tour package and service provider:

• Cancellation 30+ days before departure: 90% refund
• Cancellation 15-29 days before departure: 50% refund
• Cancellation 8-14 days before departure: 25% refund
• Cancellation less than 7 days before departure: No refund

Changes by You

Changes to bookings are subject to availability and may incur change fees from the service provider plus a ₹500 administrative fee per change. Changes requested within 7 days of departure may not be possible.

Cancellation by Us

We reserve the right to cancel a tour for reasons including:

• Non-payment of balance due
• Force majeure events (natural disasters, political unrest, etc.)
• Failure to meet minimum participation requirements

In such cases, we will offer alternative dates or a full refund.

Travel Requirements for Sikkim & Himalayan Regions

For tours in protected areas of Sikkim and other Himalayan regions:

• Indian nationals require Inner Line Permits (ILP) for restricted areas
• Foreign nationals require Protected Area Permits (PAP)
• Valid photo ID (Passport for foreigners, Voter ID/Aadhar for Indians)
• Passport-sized photographs (4 copies)

While we assist with permit applications, it is your responsibility to provide accurate information and documents. Kharmiley Tours and Travels is not responsible for permit rejections or travel disruptions due to inadequate documentation.

Tour Responsibilities

As a registered tour operator, we commit to:

• Providing services as described in your itinerary
• Using licensed and insured service providers
• Maintaining appropriate licenses and registrations
• Addressing concerns promptly during your tour

You agree to:

• Follow the tour itinerary and guide instructions
• Respect local cultures and customs
• Maintain appropriate travel insurance
• Inform us of any special needs or medical conditions

Limitation of Liability

Kharmiley Tours and Travels acts as an agent for service providers. We are not responsible for:

• Acts or omissions of third-party service providers
• Personal injury, property damage, or losses during travel
• Itinerary changes due to weather, road conditions, or unforeseen events
• Delays or cancellations beyond our control

Our maximum liability is limited to the amount paid for the tour in question. We strongly recommend comprehensive travel insurance.

Special Considerations for Himalayan Tours

When booking tours in high-altitude regions:

• Consult with your physician about altitude preparedness
• Understand that mountain roads may be rough and vehicles basic
• Accommodations in remote areas may have limited amenities
• Itineraries may change due to weather or road conditions
• Mobile networks may be unavailable in remote areas

Changes to Terms

We reserve the right to modify these Terms at any time. The most current version will always be available on our website. Your continued use of our services after any changes constitutes acceptance of the modified Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Namchi, Sikkim.
